EPLL, in performing its own institutional activities, may play the role of implementing party (and the role of Intermediate Body if in the national Operational Programme) in the process of use, design, execution and spending of programs financed by the EU funds addressed to Croatia. EPLL may play the role of Intermediate Body under the condition that it is insert in the list of implementing parties of the Croatian Operational Programme that Croatia has to present to EU
EPLL will play this role from the end of 2014 / beginning of 205. Anyway, EPLL may immediately start to play the role of technical assistance for the activities that will lead to the drafting of the Operational Programme.
With this immediate activity, EPLL will contribute to the drafting of the Operational Programme with its own capabilities and competences, and the Croatia is able to use the residual funds coming from past programs that, otherwise, will be lost. Actually the funds coming from past programs are close to their expirations and there is no more time for awardthis funds through public procurement procedure. On the contrary, EPLL may be direct assignee of the funds through a direct concession contract.
What previously described is coherent with the most advanced laws and regulations, and with the most recent sentences of the European Court of Justice.
